4. PRICES AND VALIDITY OF THE OFFER
11. DISCOUNTS / PRICE REDUCTIONS
1. GENERAL PROVISIONS
The terms and conditions applicable to the online
purchase from the
www.IDASHOP.com website set out the conditions and specify
the rights and obligations of the seller (distributor) and of the buyer
(customer, client). The seller and operator of the online operations is SC
SIMEX DEVELOPMENT SRL, headquartered in Bucharest, Sector 1, at 37, Argentina
Str., 1
st floor, Postal Code 011753, VAT Code: 24751854,
J40/19340/2008. For contact information, please refer to the

of this website (this section is part of these terms and conditions).
The relationship between the parties is
governed by the following laws and regulations:
Government Order no. 21/1992 on consumer protection.
Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with
professionals.
Law no. 363/2007 on combating
the incorrect practices of traders in relation to consumers and harmonizing the
regulations with the European legislation on consumer protection.
Law 365/2002 on electronic commerce.
The provisions of Government Emergency
Ordinance 34/2014 apply only to the consumer defined as any natural person or
group of natural persons established in associations as defined in Art.
2 paragraph 2 of Government Order no. 21/1992 on consumer
protection, republished, with subsequent amendments and completions.
2. DEFINITIONS
Sales contract - any contract under which the
seller transfers or undertakes to transfer ownership of the goods to the
customer and the customer pays or undertakes to pay the price thereof.
Seller (distributor) - a person who, in
accordance with the terms and conditions of the contract, offers the product to
the customer.
Any natural or legal
person, whether public or private, acting in the course of its commercial,
industrial or production, craft or freelancing activity in connection with
contracts under the Government Emergency Ordinance no.
34/2014, as well as any person acting for the same purpose,
on her behalf or her name.
Customer
(buyer) - any natural person or group of individuals established in
associations, who, in accordance with the terms and conditions of the contract,
acts for purposes outside its commercial, industrial or production, craft or
freelancing business.
Distributor (Distributor) - an authorized
natural or legal person who, in the course of her professional activity, in
accordance with the terms and conditions of the contract, manufactures,
imports, transports or markets products or parts thereof or provides services.
Concluding the sales contract - The order
placed by the buyer constitutes a deed producing legal effects, provided the
seller confirms and accepts the order.
From the moment of the
acceptance of the order by the seller and the receipt by the buyer of the
acceptance of the order, a contract is created between the parties producing
rights and obligations of both parties, as defined in the contract or in these
terms and conditions, which are an integral part of this contract.
Terms and conditions - the contractual
agreement between the seller and the buyer, in accordance with the terms and
conditions set out in this section.
The buyer accepts the
terms and conditions in which the contract is concluded at the time of the
order submission, an order that produces legal effects from the moment of the
conclusion of the sales contract by the confirmation and acceptance of the
order by the seller.
The buyer undertakes to
acknowledge these terms and conditions, which he/she is deemed to have accepted
from the moment the order is sent to the seller.
Right of withdrawal - You have the right to
withdraw from this agreement, without giving any reasons, within 10 days.
The withdrawal period expires after 10 days
starting from the day:
-On which you or a third party other than the
carrier, indicated by you, come into the physical possession of the products.
-On which you or a third party, other than the
carrier, indicated by you, come into the physical possession of the last
product, if you have ordered multiple items in a single order and these have
been delivered separately.
3. PAYMENT METHODS
Credit Card - This payment method is fully
secured.
At the time of payment, in order to ensure the protection of transactions, the transmission of
your confidential data is made directly through the PayU payment processor.
We accept MasterCard, Visa and American Express credit and
debit cards.
Paypal - Log in to your PayPal account to make the payment.
PayU - Secure credit card payment processor.
Payment Order - This type of payment is made only on the basis of the pro forma invoice sent by www.IDASHOP.com (SC Simex Development SRL) to the email address associated with the account through which the order is placed.
The delivery of the products is made after
confirmation of payment of the pro forma invoice issued for the account
specified in the document.
4. PRICES AND VALIDITY OF THE OFFER
All prices include taxes and are final. The prices are those from the date of ordering the products,
regardless of any subsequent price changes.
Product prices are based on the exclusive
distributor's recommended prices.
The photos for the product are for presentation purposes
5. ORDER
The buyer can place orders by adding the
product(s) to the shopping cart and following the steps to enter the contact
and delivery details and select the payment method.
Adding a product to the shopping cart if the order is not
completed does not result in the registration of an order and, implicitly, the
automatic reservation of the product.
Once completed, the order details can be
checked both in the attachment of the confirmation message and in the Orders
section of the user account on our website.
By finishing the order, the buyer agrees that
all the data provided, necessary for the purchase process, is accurate,
complete and true.
Acceptance of the order occurs when the invoice
is issued.
6. ORDER PROCESSING
Once you have registered your order, you will
receive an automatic confirmation reply by email.
Orders received until 12 o'clock are usually processed on the
same day or the next business day.
Products are
usually delivered within 7-14 business days.
Although
98% of the products are always in stock, the delivery time may, exceptionally,
be extended.
For custom products, you will be contacted by an
operator to tell you the exact delivery time and shipping conditions.
7. SHIPPING
Shipping is free of charge within 1500 km of Milan (±50 km).
You can find out if you qualify for free shipping using Google Maps.
The delivery of the products in the
manufacturers' stock is carried out by an international courier company.
For products in stock at the manufacturer, the
delivery takes between 7-14 business days.
For products not in
stock, the delivery time is at least 30 working days, depending on the
manufacturer.
At the time of sending your order,
you will receive an electronic confirmation containing details of the courier
company and the package number.
8. RETURNS AND REFUNDS
You can return products in one of the following
situations:
-The product does not comply with the
specifications mentioned in the order confirmation.
-The product is damaged.
-You are
not satisfied with the item that you purchased.
-You do not want a product you ordered anymore.
You have 14 calendar days from the time of
pickup to request the replacement or return of the product.
Please consider the following:
The costs incurred by the customer are the delivery costs of the products (Italy-client and client-Idashop, Commercial Office - S.C. Simex Development S.R.L. - 37 Argentina Street, district 1, 011753, Bucharest, Romania, ).
The Customer is obliged to notify in advance IDASHOP.COM of his intention to return the products he /she has purchased by written notification (at [email protected]) within maximum 14 calendar days of receipt of the products .
Custom-made and personalized products are NOT
returnable.
The customer cannot return the products if they
have marks, cuts, stains and detached labels, or if the original packaging is
damaged.
In case of product refund, the costs will be
refunded by bank transfer within 14 days from the date of receipt of the products.
In the event of product replacement with an
identical or with another product, as a result of non-compliance with the item
specifications or deterioration of the product, the replacement will be made
subject to the conditions and limits of a regular order.
In all cases, the return/re-shipping costs will
be borne by the customer.
IDASHOP.COM may refuse to deal with customers who have abused the right to renounce the purchase.
9. WITHDRAWAL FORM

I hereby notify you of my withdrawal from the
contract regarding the sale of the following products:

In order to comply with the withdrawal
deadline, it suffices to send the notice on exercising your right of withdrawal
before the expiry of the withdrawal period.
If you withdraw, we shall refund you the amount
without undue delay and, in any event, no later than 14 days after we are
informed of your decision to withdraw from this agreement.
We will perform the bank transfer refund (the buyer must
specify an IBAN account, consisting of 24 characters);
in any case, you will not be charged any fees as a result of
such reimbursement.
We may postpone the
reimbursement until the date we receive back the products from you or until you
have provided us with proof that you have returned the products, whichever
occurs earlier.
If you have received the ordered products,
please send the products without undue delay to the following address: SC SIMEX
DEVELOPMENT SRL, 43, Argentina Street, Sector 1, Bucharest, Romania, Postal
Code 011753 and, in any event, within 10 days of the date you notified us of
the withdrawal.
The deadline is
observed if the products are sent back before the expiration of the 10-day
period.
10. WARRANTY AND COMPLAINTS
The warranty is taken into account from the
date of delivery of the product to the buyer and is valid for a period of 6 months.
The seller is responsible for all product faults existing at
the delivery date or occurring within the warranty period.
A complaint must be made by e-mail or by message, at the
address specified in the "About Us" section of this website or
“Contact us” section.
The customer will be
reimbursed the value of the product into a bank account communicated by that
customer.
The complaint must include a
description of the fault/defect in question and a copy of the invoice (or any
other document proving the purchase).
Any
complaint will be processed within 48 hours and the customer will be informed
of the findings.
The return procedure will be
emailed to the customer within 48 hours of the receiving the complaint.
Warranty will be accepted in the following
cases:
-In case of a defect that can be removed, the
product will be partially or totally changed.
If the defect cannot be removed due to its disproportionate
nature, and the replacement of the product is not possible, the customer will
be able to receive the amount of money into an IBAN account.
-If there is a defect that prevents the use of
the product, its replacement or renunciation of the purchase.
-In the case of multiple or repeated defects,
replacement of product or renunciation of purchase.
Repair of the defect exists when the same defect, which
prevents normal use, has been removed at least twice during the warranty period
and has recurred.
Multiple defects mean at least
3 defects that prevent normal use.
-In the case of other defects that cannot be
eliminated and that do not require the replacement of the product, the customer
will be entitled to a reasonable discount or renunciation of the purchase.
Depending on the nature of the case, a warranty
certificate may not be required, proof of purchase being sufficient and
necessary.
Complaints regarding defects found will be
processed without any delay, unless otherwise agreed by the parties.
The seller will notify the buyer of the deadline and manner
of processing the complaint, including confirmation of the necessary repairs
and their duration, or, if appropriate, the written reasons for the refusal to
comply with the request.
11. DISCOUNTS / PRICE REDUCTIONS
In the online store, we grant different types
of discounts.
If several types of
discounts can be applied to a product, they are cumulative.
Any discount code may be used only once, unless
otherwise explicitly provided.
In case of abusive
multiple use, the seller has the right to refuse the use of the discount code.
12. PERSONAL DATA PROCESSING
The data processing is fully consistent with
Regulation (EU) 2016/679 (the "General Data Protection Regulation" or
"GDPR").
All personal data that you communicate to us
will not be communicated to third parties without your prior consent and will
be processed in accordance with the applicable personal data protection
legislation.
You benefit from the
right of access, data interference, the right not to be subject to an
individual decision and the right to appeal to the courts.
At the same time, you have the right to oppose the processing
of your personal data that concerns you and ask you to delete the data.
For the exercise of these rights, you can address with a
written request to the customer support department by e-mail at
[email protected]. It is also recognized the right to address the law.
You can always request modification, update, or deletion from
the database.
By creating the account and sending the order,
the buyer agrees with the processing of personal data.
Which categories of personal data we process
Generally, we collect your personal data
directly from you, so you have control over the type of information you give
us.
For example, we get
information from you as follows:
When you create an account, you submit: the
email address, the first and last name;
When placing an order, you provide us with
information such as the product you want, name and surname, delivery address,
billing details, payment method, phone number, etc.
We can also provide you the opportunity to sign

If you choose one of these options, you will be redirected to

The transmission of your personal data is done
using state-of-the-art encryption algorithms and stored on secure servers while
ensuring data redundancy.

payment processor.
13. COPYRIGHT
All information presented on www.IDASHOP.com is
the property of SC SIMEX DEVELOPMENT SRL;
the use of this
information without the agreement of SC SIMEX DEVELOPMENT SRL shall be punished
according to the laws in force.

The customer may be required to complete
certain forms and/or to conclude certain contracts at the time of placing the
order.
The procedure may
vary, depending on the order.
Contracts can be
concluded in English.

present terms and conditions allow the buyer to archive and reproduce them.
Tariffs for remote communication for placing orders are
the normal tariffs charged by operators of these networks.
